  • Cilvēku tirdzniecība saskaņā ar Latvijas Republikas Krimināllikuma 154.2.panta pirmo daļu ir ekspluatācijas nolūkā izdarīta personu savervēšana, pārvadāšana, nodošana, slepšana vai saņemšana, lietojot vardarbību vai draudus, vai aizvešanu ar viltu vai izmantojot personas atkarību no vainīgā vai tās bezpalīdzibas stāvokli, vai arī dodot vai saņemot materiāla vai citāda rakstura labumus, lai panāktu tās personas piekrišanu tirdzniecibai, no kuras ir atkarīgs cietušais.

    Ekspluatācija ir personas iesaistīšana prostitūcijā vai cita veida seksuālā izmantošanā, piespiešana veikt darbu vai sniegt pakalpojumus, turēšana verdzībā vai citās tai līdzīgās formās ( parādu verdzība, dzimtbūšana vai personas cita veida piespiedu nodošana citas personas atkarībā), turēšana kalpībā vai arī personas audu vai orgānu nelikumīga izņemšana (Krimināllikuma 154.2.panta trešā daļa).

  • Trafficking in Human Beings
    The UN Traffi cking Protocol defi nes traffi cking in persons as:
    (a) “…the recruitment, transportation, transfer, harbouring or receipt of persons, by means
    of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception,
    of the abuse of power or of a position of vulnerability or of the giving or receiving of payments
    or benefi ts to achieve the consent of a person having control over another person,
    for the purpose of exploitation. Exploitation shall include, at a minimum, the exploitation
    of the prostitution of others or other forms of sexual exploitation, forced labour or services,
    slavery or practices similar to slavery, servitude or the removal of organs;
    (b) The consent of a victim of traffi cking in persons to the intended exploitation set forth
    in subparagraph (a) of this article shall be irrelevant where any of the means set forth in
    subparagraph (a) have been used;
    (c) The recruitment, transportation, transfer, harbouring or receipt of a child for the purpose
    of exploitation shall be considered “traffi cking in persons” even if this does not involve
    any of the means set forth in subparagraph (a) of this article;
    (d) ’Child’ shall mean any person under eighteen years of age.” (United Nations (2000b): Protocol to Prevent, Suppress and Punish Traffi cking in Persons, especially Women and Children,
    Supplementing the UN Convention against Transnational Organized Crime. Art.3)
